Welcome to unspkn ("the App"), an encrypted messaging application developed and operated by Unspkn ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Eligibility

The App is rated 17+ on the App Store and Google Play. The App is not directed at children and is not designed for use by children. By using the App, you represent and warrant that you are of sufficient age to use the App in accordance with applicable law.

2. Account Registration

• You must create an account with a unique handle and security gesture to use the App.
• You are responsible for maintaining the confidentiality of your security gesture and for all activity that occurs under your account.
• You agree to provide accurate information and to update it as necessary.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights.
• Send spam, unsolicited messages, or bulk communications.
• Harass, threaten, intimidate, or bully other users.
• Distribute malware, viruses, or other harmful content.
• Impersonate another person or entity.
• Distribute content that exploits, harms, or endangers minors.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Circumvent or interfere with any security features of the App.

5. Subscriptions and Purchases

• The App is free to download with a core set of features available at no cost.
• Additional features ("Pro features") are available through in-app purchases managed by the Apple App Store and Google Play Store.
• All purchases are processed by and subject to the terms of the respective app store. We do not directly handle payment information.
• Subscription renewals, cancellations, and refunds are governed by the policies of Apple or Google, as applicable.
• We reserve the right to change pricing for Pro features at any time. Price changes will not affect active subscription periods.

6. User Content

• You retain ownership of all content you send through the App.
• Because messages are end-to-end encrypted, we do not have access to your content and do not claim any rights to it.
• You are solely responsible for the content you share and must ensure it complies with these Terms and applicable laws.

7. Blocking and Reporting

• You may block any user at any time to prevent them from contacting you.
• You may report users for violations of these Terms. Reports are reviewed by our team.
• We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

8. Intellectual Property

The App, including its design, code, features, branding, and all related intellectual property, is owned by Unspkn. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimers

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not responsible for any loss of data, including encrypted messages, due to device loss, gesture loss, or technical issues.
• Styles, translations, and decoy conversations are for message disguise purposes and may not be perfectly accurate translations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Unspkn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Unspkn from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Termination

• You may stop using the App at any time and request account deletion by contacting contact@unspkn.app.
• We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion.
• Upon termination, your right to use the App ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on this page with a revised "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
